Talk of a wire worn by informant but no mention of documentation stating wire was legal and turned in as supporting documentation. Mr. Chris Diaz also had a duel role in being an informant for Gator Role as well.. Which brings me to this question; If the R.I.C.O, act had already been established and this and Mr Nava’ prior plea deal for attempted murder fall under G.R. why is this not a federal case for some or all of these involved.. I mean we have being a “Soldier” under Gator Roll but not Murder?





Reference Material in regards to Ricardo Nava accepting a plea deal for a crime committed as a minor? “THE STORY READS “ Three Eastside gang members – Omar Ramos Erick Roman and Ricardo Nava- all pleaded guilty to attempted murder with a gang enhancement and were sentenced in Santa Barbara Superior Court on 1/25. Ramos was sentenced to twenty years, both for the aforementioned charges and for a gang strike. Roman received a total of 17 years 8 months and Nava’s sentencing will have him in prison for the rest of 19 years. Now the reason I have taken the time to review just the first 2 days of court is this. With the Corruption and track record of our Santa Barbara District Attorney Office in regards to alleged Gang Crimes and our star witness Karen Adkins. Will she be available to testify to her Superior Court Documented charges of misconduct against the Santa Barbara Superior Court and district Attorney prosecutors. Having said that can we really trust the defense these defendants are receiving? Not one change of venue request? Resisting out side counsel to help in the defense of these defendants?. The constant and there is no other way to say this “FABRICATION” of any kind of data used in this county to distort the facts and false accusations made in the Media to lie to the public.

Defendants' Rights During a Court Trial: The Bill of Rights

The Bill of Rights promises fair treatment and constitutional rights for criminal defendants.

Right to Adequate Representation

The U.S. Supreme Court has ruled that both indigent defendants who are represented by appointed counsel and defendants who hire their own attorneys are entitled to adequate representation -- that is, to have a lawyer who does a reasonably good job at defending the defendant.

However, adequate representation is by no means perfect representation. Here are examples of claims that defendants have made to get their guilty verdicts thrown out but that appellate courts have rejected:

· the attorney failed to call favorable witnesses at trial

· the attorney failed to object to a judge's mistaken instructions to jurors concerning the burden of proof

· the attorney repeatedly advised a defendant who claimed innocence to plead guilty

· the attorney used cocaine during the time the representation took place, and

· the attorney represented the defendant while being suspended from the practice of law for failure to pay state bar dues.

On the other hand, circumstances can be sufficiently shocking to justify throwing out a guilty verdict based on an attorney's incompetence. Judges have ruled that the following claims justify a reversal of a guilty verdict:

· the attorney put a law student intern in charge of the defense and left the courtroom while the case was going on

· during closing arguments, the attorney acknowledged that the defendant was guilty of a lesser crime without first securing the defendant's approval of this tactic, and

· during voir dire (questioning of the jury), the attorney failed to challenge two potential jurors who said they would be bothered by the defendant's failure to testify





Inclosing I leave you with this thought. Are these and other defendants being set up for the same charges only in Federal Court based on the past R.I.C.O. act and Gator Roll. It can happen so please read below. Now if they have some type of plea deal in place was the defendant advised and protected from this happening?

Right Not to Be Placed in Double Jeopardy

Among the clauses of the Fifth Amendment is this well-known provision: "nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb." This provision, known as the double jeopardy clause, protects defendants from harassment by preventing them from being put on trial more than once for the same offense. Double jeopardy problems are unusual, because prosecutors usually want to wrap up all their charges at one time in the same case.

One important exception to the rule against double jeopardy is that defendants can properly be charged for the same conduct by different sovereigns. For example, a defendant may face charges in both federal and state court for the same conduct if some aspects of that conduct violated federal laws while other elements ran afoul of the laws of the state.

Furthermore, the double jeopardy clause forbids more than one criminal prosecution growing out of the same conduct. A defendant can be brought once to criminal court (by the government) and once to civil court (by members of the public) for the same offense.

"Gator Roll" Alleged "R.I.C.O. Act dealing with Santa Barbara "Gangs". Where is the Real Corruption? In the District Attorneys Office and Superior Courts!

Is it just me or did anyone notice in my recap from the 3 news press stories yesterday what's missing? I see no reported opening remarks from the District Attorney prosecuting the case. How can the general public decide if they met there obligation. What a coincidence that this went to trial and is getting so much attention just as we are about to vote for District Attorney. Marketing is everything in Santa Barbara. No opening remarks to present the defendants defense in the press either for public knowledge. Than I looked at the witness's and what as been placed before us so far and have to ask? Who was the investigator that placed the wire on the informant? Would he not be called up first to set the stage and clear all legality's and any challenges a good defense attorney might have ?However what is most obvious is that the witness's are being called up before any fact from law enforcement has been presented to the jury. Now it also seams a conflict of interest to testify before fact has even attempted to be established. So all I do see is 4 defense Attorneys doing a Tango to the District Attorneys beat at the cost of the Constitution of our United States.

Now I am sure even the Superior Court Judge would be aware to advise the defendants of there Constitutional rights because of the presence of “ R.I.C.O.”

JOINT LAW ENFORCEMENT OPERATION LEADS TO ARREST OF NINE MEMBERS OF VIOLENT SANTA BARBARA STREET GANG



A joint federal-state law enforcement operation this morning led to the arrest of nine members of a Santa Barbara gang who are named in a federal racketeering indictment that alleges the gang has engaged in murder, attempted murder, conspiracy to commit murder, conspiracy to distribute narcotics, distribution of narcotics and robbery. This case represents the first racketeering case ever brought on the Central Coast.

The indictment charges a total of 28 defendants, including 19 under the Racketeer Influenced Corrupt Organizations (RICO) Act. Several defendants are additionally charged with violent crimes in aid of racketeering, as well as distribution of heroin and distribution of cocaine, in the indictment returned last week by a federal grand jury in Los Angeles. In addition to the nine defendants arrested this morning, 17 defendants charged in the indictment are already in custody on state charges and are expected to be turned over to federal authorities. Authorities are continuing to search for two defendants.

The federal racketeering case brought against the Eastside gangsters will go a long way towards protecting the citizens of Santa Barbara and the numerous visitors who come here every year,” said United States Attorney Thomas P. O’Brien. “We will continue to work with our local law enforcement partners throughout this district to combat gang violence."

In addition to the federal RICO case, the Santa Barbara County District Attorney’s Office is expected to charge 17 defendants in Superior Court. Immigration authorities additionally arrested one person on suspicion of being an illegal alien.

The Eastside gang has claimed as its turf the area east of State Street in the central part of Santa Barbara. Broken into four sub-groups or “cliques,” the gang is believed to be comprised of more than 150 members, some as young as 11.

The indictment alleges that members of the gang frequently engaged in“cruising,” in which Eastside members armed themselves with an array of deadly weapons, including knives, baseball bats, and pipes, and drove in groups to Westside gang territory to attack members or associates of that gang.

Eastside rules required that members of the gang attack individuals who enter areas frequented by the gang, including individuals who might be in gang areas to shop in stores or eat at restaurants, according to the indictment, which also alleges that the gang was hostile to the presence of African-Americans in areas frequented by the gang. Eastside members intimidated, threatened and assaulted persons in areas they frequented as a means to control the people in those neighborhoods, including potential witnesses who might testify in court about their crimes.

The indictment alleges that the gang was responsible for the murders of two rival gang members last year. The indictment also alleges that gang members attempted to kill six other victims.

ATF will continue to have a presence wherever gangsters have a presence,” said John A. Torres, Special Agent in Charge of ATF’s Los Angeles Field Division. “We will not allow them to victimize our neighborhoods through their criminal activities. As a team, federal and local law enforcement agencies are committed to making sure that gang members feel the impact of justice brought forth upon them.”

Salvador Hernandez, Assistant Director in Charge of the FBI in Los Angeles, stated: "The FBI has partnered with the City of Santa Barbara and the ATF to address the recent escalation of gang-associated violence in the city of Santa Barbara. The Eastside gang, like many others, pursues its criminal objectives through violent acts, including murder, robbery and assault. Taking the most violent criminals off the streets and sending them to prison for many years is a step toward restoring order in the communities in which they operate."

The indictment charges 19 defendants with participating in a conspiracy to violate the Racketeer Influenced and Corrupt Organizations Act, a count that alleges 205 overt acts related to the conspiracy. The indictment also names various defendants in 13 counts of violent crime in aid of racketeering, one count of discharge of a firearm during and in relation to a crime of violence, two counts of conspiracy to distribute cocaine, seven counts of distribution of cocaine, three counts of distribution of methamphetamine, two counts of distribution of heroin, one count of sale of a firearm to a prohibited person, and one count of possession of a destructive device (Molotov cocktail).

“Today's operation has dealt a severe blow to one of the most dangerous street gangs operating in this area,” said Robert Schoch, special agent in charge for ICE investigations in Los Angeles. “Attacking and dismantling these ruthless organizations is one of ICE’s enforcement priorities and we will continue to work closely with our law enforcement partners to protect the community from the violence, crime and fear fostered by these gangs.”

The investigation into the Eastside gang was conducted by the Santa Barbara Police Department; the Bureau of Alcohol, Tobacco, Firearms and Explosives; the Federal Bureau of Investigation; U.S. Immigration and Customs Enforcement; and the Santa Barbara County District Attorney’s Office.

The main investigating agencies received assistance during this morning’s takedown from the Drug Enforcement Administration, the California Bureau of Narcotic Enforcement, the United States Marshals Service, the Santa Barbara County Sheriff’s Department, the San Luis Obispo County Sheriff’s Department, the Santa Maria Police Department, the Lompoc Police Department, the Ventura County Sheriff’s Department, the Ventura Police Department, the Oxnard Police Department, the Santa Paula Police Department, the Santa Barbara County Probation Department, and the California Department of Corrections and Rehabilitation (Parole Operations).

FEDERAL-LOCAL LAW ENFORCEMENT ACTION TARGETS 25 MEMBERS OF ENTRENCHED SANTA MARIA STREET GANG



An FBI-led task force, working in conjunction with local police, has targeted a Santa Maria street gang, marking the first time that federal authorities have joined with local police and prosecutors to identify and prosecute people affiliated with a Central Coast street gang.

This morning, in a coordinated effort involving approximately 75 law enforcement officials, 11 defendants were arrested on federal and state charges. They are among 25 people charged by prosecutors in relation to criminal activity associated with the Northwest gang, which has operated for decades in the City of Santa Maria.

“As we have demonstrated over the last several years, the only way to effectively fight the gang problem that plagues too many neighborhoods in our district is for local, state and federal authorities to join together to combat this issue,” United States Attorney Thomas P. O’Brien said at a press conference in Santa Maria. “You are seeing this collaborative effort for the first time on the Central Coast.”

Federal prosecutors have charged 17 defendants related to the Northwest gang. Several of the defendants potentially face sentences of life in federal prison, where there is no parole. All 17 defendants are facing mandatory minimum sentences of at least five years. The Santa Barbara County District Attorney’s Office has charged the remaining eight defendants.

During the investigation, which was conducted by the FBI’s Central Coast Safe Streets Task Force, working in conjunction with the Santa Maria Police Department, investigators seized nearly two pounds of methamphetamine, over five ounces of cocaine, two handguns and an assault rifle.

"We are pleased to be part of this partnership, which takes a regional approach to the suppression of criminal gang activity," said Santa Barbara County Sheriff Bill Brown. "The formation of the Central Coast Safe Streets Task Force is a shining example of law enforcement agencies working together to make our communities safer. It is part of our continuing commitment to a blended approach to dealing with gang activity and gang violence on the Central Coast. That approach involves a variety of enforcement, intervention, and prevention efforts."

The federal defendants are all charged with trafficking methamphetamine. The charges filed by the Santa Barbara County District Attorney’s Office include possession of methamphetamine for sale and felon in possession of a firearm.

“Today’s operation shows how successful actions joining local and federal resources to target dangerous criminal gang activities in our communities,” stated Santa Barbara County District Attorney Christie Stanley. “It is our goal to make our cities and streets safer for all with operations such as this.”

At a press conference in March, United States Attorney General Michael B. Mukasey announced the formation of the Central Coast Safe Streets Task Force, although at that time the location of the Task Force was not revealed so as to maintain the integrity of the investigation being announced today. The FBI now has six Safe Streets Task Forces operating in the seven-county Central District of California. The Safe Streets Violent Crime Initiative allows each FBI Field Division to address violent street gangs and drug-related violence through the establishment of FBI-sponsored, long-term, proactive task forces focusing on violent gangs, crimes of violence, and the apprehension of violent fugitives.

"Unfortunately, the nation's gang problem, for so long confined to its biggest cities, has spread to less urban and populated areas – including California's Central Coast," said Salvador Hernandez, Assistant Director in Charge of the FBI in Los Angeles. “To counter the threat locally, the FBI and its law enforcement partners in Santa Barbara and San Luis Obispo Counties have joined forces. Today's arrests, the product of the Central Coast Violent Gang Safe Streets Task Force established earlier this year, demonstrate that joint commitment."

San Luis Obispo County Sheriff Pat Hedges commented: "Illegal street gang activity in our communities deserve our full attention, and they are receiving it. The cooperative effort between local and federal law enforcement and local and federal prosecutors will have a tremendous impact on curtailing gang-related crimes in our area."

The investigation into the Northwest gang resulted in 17 defendants being indicted by a federal grand jury in Los Angeles. All but one of those 17 are residents of Santa Maria. Those defendants are listed below in order of the maximum potential mandatory minimum sentence they are facing.

Subject to a mandatory life in prison sentence:

Daniel Valdez Benitez, aka Sporty, 28, who is charged with conspiring to distribute approximately 110 grams of methamphetamine, was arrested earlier this year and is scheduled to go to trial on December 16.
Subject to a 20-year mandatory minimum sentence:

Adrian Armando Guerrero, aka Big A, 37, who is charged with trafficking approximately 90 grams actual methamphetamine, is currently in state custody.
Michael Anthony Liendo, aka Big Mike, 34, who is charged with trafficking approximately 90 grams actual methamphetamine, was arrested this morning.
Alexander Simartin Nogalez, 31, who is charged with trafficking approximately 90 grams actual methamphetamine, was taken into custody yesterday on a parole violation.
Jesse Anthony Nunez, aka Birdy, 29, who is charged with conspiracy to distribute approximately 110 grams of methamphetamine, was arrested earlier this year and is scheduled to go to trial on December 16.
Subject to a 10-year mandatory minimum sentence:

Anna Marie Leal, 21, who is charged with trafficking approximately 90 gramsof methamphetamine, was arrested this morning.
Christoval Pena, 50, of Oceano, who is charged with trafficking 18.5 grams of methamphetamine, is currently incarcerated in state prison.
Rupert Nicolas Rodriguez Jr., 31, who is charged with trafficking approximately 70 grams of methamphetamine, was arrested this morning.
Subject to a five-year mandatory minimum sentence:

Francisco Gerardo Alcala, aka Francisco Geraldo Alcala and Big Sporty, the brother of Daniel Benitez, 35, an illegal alien from Mexico, who is charged with trafficking approximately 10 grams of methamphetamine, was arrested earlier this year and is scheduled to go to trial December 2.
Amy Josette Garcia Estrada, 40, who is charged with trafficking approximately 5.4 grams actual methamphetamine, is currently in state custody, but is expected to be turned over to federal authorities today.
Christina Pauline Valdez, aka Christina Pauline Samaniego and Misdemeanor, 32, who is charged with trafficking 10 grams of methamphetamine, was arrested earlier this year and is scheduled to go to trial on December 2.
Eddie Joseph Ward, 27, who is charged with trafficking 10 grams of methamphetamine, was arrested this morning.
Joe Anthony Ward, aka Caveman, 29, who is charged with trafficking 10 grams of methamphetamine, was arrested yesterday.
The defendants arrested yesterday and today on federal charges, as well as those already in custody on probation or parole violations, are expected to make their initial court appearances tomorrow morning in United States District Court in Los Angeles.

There are four fugitives currently being sought by authorities who are facing federal charges. They are:

Peggy Sue Liendo Velasquez, 50, who is charged with trafficking approximately 90 grams of methamphetamine;
Santina Marie Rea, 26, who is charged with trafficking 18.5 grams of methamphetamine;
Vincent Nathaniel Beltran, aka Smalls, 19, who is charged with trafficking approximately 10 grams of methamphetamine; and
Cesar Raul Castillo, 41, who is charged with trafficking approximately 10 grams of methamphetamine.
Seven of the eight defendants facing charges in Santa Barbara Superior Court were arrested this morning. The defendants facing local charges are:

Amanda Chavez, 26, of Santa Maria;
Armando Chavez, 26, of Santa Maria;
Amy Estrada, 40, of Santa Maria;
Javier Limon, 31, of Santa Maria;
Fernando Medina, 32, of Nipomo;
Salvador Medina, 34, of Irving, Texas (who is still being sought);
Lorraine Valdez, 32, of Santa Maria; and
William Martinez, 30, of Santa Maria;
The first six state defendants are charged with narcotics offenses, while Valdez is charged with conspiracy to commit the crime of felon in possession of a firearm and Martinez is charged with grand theft.

The federal indictments and the charges filed by the Santa Barbara County District Attorney contain allegations that a defendant has committed a crime. Every defendant is presumed to be innocent until proven guilty.

The cases announced today are the result of a coordinated investigation by the FBI’s Central Coast Safe Streets Task Force, which is made up of agents from the Federal Bureau of Investigation and investigators with the Santa Barbara County Sheriff’s Department and the San Luis Obispo County Sheriff’s Department. The Santa Maria Police Department worked in close collaboration with the Task Force.

During this morning’s takedown, the Task Force received the assistance of the Drug Enforcement Administration; the Bureau of Alcohol, Tobacco, Firearms and Explosives; U.S. Immigration and Customs Enforcement (ICE); the Lompoc Police Department; and the United States Marshals Service.

Now many times when I share an idea with you all on my blog the neatest thing tends to happen immediately after. It seams more often than not my current thought or idea is some how part of our news in a very short time after I have made my statement. Take for instance the lack of funding for the Education of our kids right here in California. I used our lottery system as an example of why there was a contract not being honored by our State. An low and behold the good people in Alameda California have agreed with me. Immediately below is the very first portion of the lottery law and where you can find it. Right after that is the story from Alameda California in regards to our education funding crisis here in this State. After that is my letter telling our State representative he has broken our contract. All I am trying to do is say that we all see things that are just not right, take a chance and share your concerns; I know the next great idea comes from all of us! That’s why I believe in MAGIC!

filed a lawsuit Thursday in the Superior Court of California in Alameda asking that the state’s education finance system be declared unconstitutional. It also seeks creation of a new process by which schools are equitably funded.
California’s public schools have been battered by budget cuts in recent years. The state Constitution gives education financing a unique priority by requiring that "from all state revenues there shall first be set apart the monies to be applied by the State for support of the public school system.” The lawsuit argues that recent budget cuts have violated this requirement.
In the last two years, $17 billion has been cut from schools and colleges, and several billion more in cuts are scheduled. California once was No. 1 in the country in per pupil spending; now it is 47th, spending $2,856 less per pupil than the national average, according to the California School Boards Association.
From 1929 to 1935, during the Great Depression, per pupil funding in California dropped 20 percent, according to Scott Plotkin, executive director of the California School Boards Association. In the last two years, per pupil funding in the state has gone down 18 percent.
The lawsuit, Robles-Wong v. California, was filed by a coalition, including more than 60 individual students and their families, nine school districts across the state, the California School Boards Association (CSBA), California State PTA, and the Association of California School Administrators (ACSA).
Shool financing has been so battered by instability that it has been impossible for districts to deliver to California’s diverse student population the education guaranteed under the Constitution, the suit contends.
Only half of all California students are proficient in English-language arts nd less than half (approximately 46 percent) are proficient in math. In addition, less than 70 percent of California students graduate from high school.
Of course, even if the lawsuit is successful, it will take years to go through the California courts. California's leaders need to rethink their commitment to public education right now.

Dear Governor Swartzenager of California;

It has become apparent that our California Government has failed in there contract with its citizens in dealing with the funding of our children’s education. The tax payers of California and our past Government representatives came upon and structured a California lottery to benefit the education of our children while providing a lottery to participate in. The deal was voted on and the contract was made. The funds created by our new lottery were to be used as additional funding and never instead of or replacing the responsibilities of our Government for the schools of California. In your current and past budgets you and others before have reduced the funding to our schools and thus have broken the law we had created. You see I feel since you have broken the contract we have created by the vote of the people you have thus abandoned your right to receive any Lottery proceeds. Was the creation of the California Lottery not a contract between government and its citizens? Did we not draft terms in which to hold the contract valid? I feel there is no disputing these facts and that the California Government must now return all funds we provided with interest back to the Lottery Pool. From there the lottery must refigure all jack pot winnings and disperse funds accordingly.

Or the Government can balance past deficits and currently fund the schools and bring our contract valid. As for moving forward maybe we need a new contract and change the requirements of all involved.

46-year-old Santa Maria man died in unit; cause of death pending

A Santa Maria man died last month at Santa Barbara County’s Psychiatric Health Facility, which is operated by the Department of Alcohol, Drug and Mental Health Services.

Sheriff’s Department officials have confirmed for Noozhawk that Clifford Detty, 46, of Santa Maria, died at 1:45 a.m. April 29 in the PHF unit, 315 Camino del Remedio in Santa Barbara. He was transported to the facility by Santa Maria police, but details surrounding his death are still unclear.

Sheriff’s spokesman Drew Sugars said last week that the department is awaiting Detty’s final toxicity screens, which will reveal the exact cause of death. Sugars said the results should be available within a few weeks. In the meantime, “we are investigating the manner and mode of death,” he said.

Noozhawk reached ADMHS executive director Ann Detrick on Thursday, but she said she could not release any information on the matter at this time.

The PHF facility where Detty died is a 16-bed compound and is the only place in the county for involuntary patients, defined as individuals who present a danger to others or themselves as a result of a mental illness.

Detty’s own obituary states that he died suddenly in “a Santa Barbara hospital” the night of April 29, but doesn’t go into specifics.

According to the obituary, Detty graduated from Santa Maria’s Righetti High School and attended Allan Hancock College and SBCC. It described him as an athlete and surfer who loved the outdoors and as a man who “did everything to the extreme and kept his parents breathless many times.”

I had shared a story about the Psychologist a Dr. Cordero who had been arrested over 3 years ago for sexually abusing a certain patient in the Santa Maria Mental Health facility.
There is more on Doctor Cordero and his crimes while treating patients as a Psychologist for Santa Barbara County below . You have no idea how sick I feel right now. I saw that the man who had died while under care was from Santa Maria but he was a patient in the same facility as me in the Santa Barbara location. An just like me it appears he was rushed to the hospital. I hope the Sheriffs will now take my report about my beatings and been kept against my will. Here is a copy of my billing for the services I received once at Cottage Hospital as well as a clean drug test. False claims were made and there was never any documented drug use with 3 random test!


Don't get me wrong the beatings I took were from sissy's and I am had it no where near as bad as others. However it is the abuse to your soul that I guess must feel like rape that haunts me.

Cordero gets seven years in prison

A former Santa Barbara County psychologist convicted of sexual battery, sexual exploitation and dissuading a witness was sentenced Friday to the maximum possible term - seven years in state prison.
Fernando Cordero, 67, apologized to the victims during his sentencing hearing in Santa Maria, and asked for leniency, but Santa Barbara County Superior Court Judge James Iwasko nonetheless handed down the strictest possible sentence.
Cordero, who worked as a psychologist with the county's Alcohol, Drug and Mental Health Services department, targeted women whom he was treating.
Before Iwasko sentenced Cordero, one of the victims and representatives speaking on behalf of other victims took turns before the court detailing the suffering Cordero had inflicted on those he took advantage of and their families.
A victim-witness advocate read a statement written by one of the victims, who said that in her grief she had wondered why she was alive, and now knows she lived to see Cordero be sentenced.
"This day belongs to us, the victims," the advocate read.
"I am your worst nightmare," she continued, addressing Cordero. "I am a survivor."
A Spanish-language court interpreter read a statement from one of the victims, who stood beside her.
Of all her abusers, Cordero was the most cruel, the victim said in the statement.
"You used me, and made me feel so bad," she said.
Cordero was convicted by a jury in April on four counts, including misdemeanor sexual battery by restraint, felony sexual exploitation by a psychotherapist or drug abuse counselor and two felony counts of attempting to dissuade a witness from reporting a crime after he had been released on bail following his arrest in November 2007.
Iwasko sentenced Cordero to three years in prison for the sexual exploitation charge, two years for the dissuading a witness counts and two years for a finding that he was out on bail when he dissuaded the witnesses. Cordero was also sentenced to 180 days in jail for the misdemeanor battery charge, but that sentence will be served concurrently with the prison time.
Cordero already has credit for 903 days in custody that will go towards his sentence.
The jury acquitted Cordero of four felony charges and one misdemeanor count, including sexual-assault charges and attempted sexual exploitation by a psychotherapist or drug abuse counselor.
The jury could not reach a verdict on three felony counts of sexual abuse and one misdemeanor count of attempted sexual exploitation by a psychotherapist or drug abuse counselor.
In May, Cordero appeared before Iwasko and pleaded guilty to the sexual exploitation by a psychotherapist or drug abuse counselor of another victim that he was not previously charged with sexual exploitation against.
In exchange for his plea agreement, Chief Trial Deputy Ann Bramsen dismissed the charges on which the jury could not reach a decision.
Cordero has not been employed by the county since December 2007, according to county spokesman William Boyer, who would not discuss the circumstances surrounding Cordero's departure.
He is not permitted to practice psychology, and must register as a sex offender.
In addition, a limited amount of discussion was held as to the possibility that Cordero could be deported when he is done serving his prison sentence due to his immigration status.
Cordero's attorney, Scott Wippert, had asked Iwasko to sentence his client to probation. Wippert said that the judge could not consider evidence pertaining to any counts that were dismissed or that Cordero was acquitted of while deciding Cordero's sentence.
Wippert pointed out that Cordero had no prior criminal history and was willing to comply with the terms of probation.
Cordero himself stood before the court and apologized to the victims and his family.
"I am deeply sorry to all the people that I have hurt," he said, adding that he was asking for their forgiveness.
He said he regretted his behavior, but that it was not done with malice.
"I have let down individuals and institutions, and I ask for their mercy."
He asked for leniency with sentencing in the interest of being able to help his family.
"I'm asking for a second opportunity to exercise my free will."
Iwasko echoed much of what Bramsen had said, which was that the victims were extremely vulnerable and that Cordero abused his position of trust as a psychologist.
Cordero committed his crimes with a high degree of callousness and sophistication, Iwasko said.
Outside court, one of the victims wept as she lamented what she thought was too short of a prison sentence for Cordero.
"That man took our lives," she said. "That man deserves more. He's a sick man."

On Wednesday the Obama administration took its first major step in a plan to ban all firearms in the United States. The Obama administration intends to force gun control and a complete ban on all weapons for US citizens through the signing of international treaties with foreign nations. By signing international treaties on gun control, the Obama administration can use the US State Department to bypass the normal legislative process in Congress. Once the US Government signs these international treaties, all US citizens will be subject to those gun laws created by foreign governments. These are laws that have been developed and promoted by organizations such as the United Nations and individuals such as George Soros and Michael Bloomberg. The laws are designed and intended to lead to the complete ban and confiscation of all firearms. The Obama administration is attempting to use tactics and methods of gun control that will inflict major damage to our 2nd Amendment before US citizens even understand what has happened.
Obama can appear before the public and tell them that he does not intend to pursue any legislation (in the United States) that will lead to new gun control laws, while cloaked in secrecy, his Secretary of State, Hillary Clinton is committing the US to international treaties and foreign gun control laws. Does that mean Obama is telling the truth?

What it means is that there will be no publicized gun control debates in the media or votes in Congress. We will wake up one morning and find that the United States has signed a treaty that prohibits firearm and ammunition manufacturers from selling to the public. We will wake up another morning and find that the US has signed a treaty that prohibits any transfer of firearm ownership. And then, we will wake up yet another morning and find that the US has signed a treaty that requires US citizens to deliver any firearm they own to the local government collection and destruction center or face imprisonment. This has happened in other countries, past and present!

As sure as government health care will be forced on us by the Obama administration through whatever means necessary, so will gun control. Santa Barbara District Attorney Candidate Josh Lynn Just does not understand Accountability and never presents true Facts.

Now it has come to my Attention Josh Lynn needs to be very careful because a S.L.A.P.P. Action may be in his future. If he continues on his current and only path of consistently misrepresenting Data, first he should be fired but we should control what he is allowed to say. A strategic lawsuit against public participation (SLAPP) is a lawsuit that is intended to censor, intimidate and silence critics by burdening them with the cost of a legal defense until they abandon their criticism or opposition! Now I have already shown that the past data forwarded to the California Judicial Council in no way reflects the actual happenings in Santa Barbara. So in an updated Data report there were over 4000 felonies filed in Santa Barbara last year and get this we go from zero, zip, nada to over 1000 felonies reduced to misdemeanors. Now mind you that was a two year “Alleged” trend of no Felonies reduced as reported by our Santa Barbara District Attorneys office to the California Judicial Council. Now if you believe the steroid numbers Mr. Lynn is constantly throwing out in public. Of the 14,000 misdemeanor and felony charges in our county a total of 80 had some type of misused “Gang Enhancement” so what is that .0000001 and that is his main focus, cheap press. Do you know how to beat Josh Lynn in a election for our District Attorney? Let him speak in public and defeat himself.

As such, the department estimates using $509,000 from the salary and benefit designation.

Well, that guy started it. --- He posted a story about finding love and respect and joy in a bar in Clovis, CA. I read it and it made my day. How often I come through CL in my daily internet surfs and perused the rants and raves section just to be disgusted and put off by the lowly, hateful, and downright stupid comments by the racist uneducated bigot losers on this site. People wasting time, energy and space. People like ROFLAY and that ilk. Give it a rest! What a joy to see something positive here.
I'd like to share one of my proudest American moments that happened just the other day:
I was in line at the grocery store behind a couple of people. The man in the front of the line did not have enough money for his food items and he struggled to choose which items he had to put back. Then he lowered his head and walked out in shame. There was a woman in front of me who took notice & quickly paid for the set aside items. Without a word, she ran out to him as he was on his way out in the parking lot. I watched as she handed him the bag. He took it, a little bewildered, and when he realized what she had done the look on his face was one of pure loving grattitude. I think he may have been amazed. She nodded politely and graciously and quickly ran off. She clearly did not know this man personally and she was seeking no retribution or thanks. In seeing this little interaction, my hope was restored that day, that we do NOT, in fact, live in a hateful hopeless world, but one where strangers actually CARE about others! I had tears in my eyes & a lump in my throat as I walked to my car. It made me think. What can I do to make this world a better, nicer, happier place?
God bless all who read this. I hope that more people will take time to post some uplifting and positive stories. Let's make a difference and cheer up this place. Let's be better. Lord knows we could...

Larry, let me share with you my special moment: I get an overwhelming sense of pride, freedom and blessedness whenever I stand with 50,000 or so strangers at Dodger stadium just before a baseball game. Covering my heart with my hand, I whisper the words to the Star Bangled Banner while it is sang loud and strong by one lone soul, often quietly accompanied by many in the crowd. Then, no sooner as the last note ends, the crowd is silenced by the thounderous roar of military fighter jets as they streak past overhead in a precision fly-by, assuring me that nothing is going to harm me tonight, not on their watch. The crowd then goes wild and roars with American pride and patriotism. Because while we enjoy America's favorite past time in the land of the free and the home of the brave, other Americans are working hard at keeping a vigilant watch and assuring the protection of our magnificent shores. Absolutely!! GOD BLESS AMERICA!!! NOW MORE THAN EVER!!!

What is your Greatest day being an American? Mine was the day I saw the NYFD after 9/11








What is the greatest feeling of pride you have ever felt about being an American? All across America people are voicing their views about what is supposedly wrong with this great nation of ours.  As for me my greatest sense of American pride came back in November of 2001. I was in Clovis California enjoying their night life. Just thinking about this brings a lump to my throat and tears my eyes. While deciding where to have a beer I heard a loud commotion coming from this one particular establishment. From outside and down the block you could feel this incredible energy coming from the inside, so that’s where I went.

Once inside I was still wondering what all the noise was about. Just cheer after cheer but I still could not make out what they were saying. As I moved forward through the crowd the room opened up and I finally saw what was causing all the excitement. First I saw the back of one of their shirts then the front of another one's jacket, Than I saw the same logo on a hat and the room had about 20 people wearing them like patches of honor as I like to say. 



The logo was F.D.N.Y. and it was being worn by the 20 or so New York Fire Fighters from 9/11. On this particular night in Clovis California in this Establishment was some of America’s greatest Hero’s ever. The place was filled with so much pride, love and admiration for these incredibly brave persons I can barely describe it. Every time I attempted to say thank you tears would form in my eyes before I could even get the words out. To instantly fall in love with a group of people was such an awesome feeling and I know the whole place felt the same as me.

It was one of those rare occasions were someone else's good time was the priority of the whole establishment. I was so proud of those brave American firefighters and all of us there were letting them know we loved them. Now people say I am odd to share a story like that but I say no. "Netting" in simple terms "This for that and Give it back". Netting in pension fund fraud accounting has many uses.

At the bottom of this posting is an example of netting in bold font a term used in accounting fraud. In some forms it can be called "this for that and give it back" It appears you hold collateral for a sale or loan. Than at some point in time one side or the other makes what amounts to a small contribution towards the others fund and securities are returned. In the case of the Santa Barbara Pension no real change under the header in question occurs until the year 2008. The example I use is taken from the 2007 audit of the Santa Barbara County Pension fund found on page 22. With the heading “Securities Lending Income” “ Securities Lending Expense”. Now this form of accounting can be used to take funds off the books, make funds look as if they are real. All right before your eyes! There is one ledger I reviewed that shows a 400,000,000 negative difference between two given years. However when the bottom line is compared the loss only transfers as a minus 270,000,000. Now I don’t care what kind of math you use there is something wrong there. “Netting” can also give a false sense some benefits came at no expense to the fund or its members. If you review every Santa Barbara County Pension fund audit available you will find this practice in place. The New York Times ran a short piece and said to make an asset disappear you might call one side of the transaction a sale and the other party might call it a loan. The practice of making a financial statements appear healthier than it is happen all the time. A good example would be when quarterly reports are given by banks. Smoothing might relate to how an IPO would mask debts down the road while showing unexposed assets as free and clear. If you review the Santa Barbara county treasurers short term accounts. There audit claims to hold several million dollars worth of stock as collateral with a repurchase date from the originating firm. Than they settle for some ungodly sum of 32,000. Now I ask you why loan out money and get the smallest return of your portfolio as a favor to some one at the expense of the County Tax Payers and employees? All I can say to you all is this is a very short version of what is being done every where by every one. Now to those of you who have been getting my emails for years I mentioned the AT&T Cellular sale to Cingular Cellular and than the sale back to AT&T as “This for that and give it back”. AT&T customers were locked into there old contracts for 1.5 years beyond the sale to Cingular. Than after every one had been transferred into a Cingular cell phone contracts AT&T bought Cingular Cellular back making us all a captive audience or consumer. Was this nothing more than a form of “netting”? It bothered me way back in 05 and no one seamed to care. Am I stupid or when something makes no sense it may just be wrong? How can a Board of Supervisor site on both the failing Pension Fund and the County Budget deficit with out a conflict of interest? For that matter how do we separate the power of the local Tax collector Treasurer so as not to continue in there ways of violating the Fiduciary Obligations to there post and the public they serve? There are many problems right before our eyes. Who runs the Santa Barbara County Court House? Not the State of California and that is why we lack a separation of powers needed to run an ethical and legal Superior court system here in Santa Barbara. Now I may be wrong on every single point I try to make and if you know so please correct me for I wish to be properly educated in the matters I have shared here.


Hang in there we have a ton to cover. 300 million a year for County schools and we stink, think about that for a moment. Property tax revenues have doubled and some how as if by magic we still run in a deficit, how can that be? I have some eye opening facts coming your way soon. Shakeup at Deputy Sheriff’s Association, Does this have anything to do with the County Pension Fund? Are these current actions related to the fact Sheriff Jobs were lost because of Pension Fraud and County Budget Deficits?

I hope that is what happen and I am glad to see the sheriffs flex there might and displeasure with what has already transpired in Santa Barbara County.

The president and vice president of the influential Santa Barbara County Deputy Sheriff’s Association(DSA), the union representing more than 450 members of the Sheriff’s Department as well as DA investigators, were voted out of office at a member meeting on 5/4. Chris Corbett, a three-term incumbent as president, lost by fewer than 10 votes to Todd Johnson, while David Brookshire, who didn’t run again for vice president, was replaced by Brenda Maynard, a custody sergeant. There was reportedly unrest in the DSA’s membership about communication coming from leadership in the union.

Something I did not know about Morgan Hill. The kids wearing the American Flag on there clothing broke the law, did you know that?

I have stayed away from the Morgan Hill issue because I feel based on what has happen in Santa Barbara and by our District attorneys office I would rather focus on matters in a different more productive way. How ever unlike most Santa Barbara politicians I have been bothered every since I found the news story below that corrects and show’s a portion of my view was incorrect. I felt a Fiduciary obligation that I must share what ever corrections I come upon on my blog with equal passion. To take this one step further later that week over two hundred kids marched in Morgan Hill with further concerns over there treatment, the kids being Americans with Hispanic, Mexican or Latino heritage. I am sadly much to busy to look further into this matter at this time but when proper time permits I will.

It’s about time.

On May 5, five high school students in Morgan Hill were sent home for wearing clothing emblazoned with the American flag. The talk shows and opinion pages are abuzz with indignation because the students were just trying to be patriotic.

Well, if they were patriotic then they were just plain stupid because the United States Code, Title 4, Chapter 1, Section 8, Subsection d states, “The flag should never be used as wearing apparel, bedding, or drapery.”

Every time I see the flag any place but on a pole, draped on a coffin or hung on a wall I just shake my head, including when it is on an athletic official’s uniform. It just doesn’t belong there. Subsection j of the above-mentioned code states, ‘No part of the flag should ever be used as a costume or athletic uniform. However, a flag patch may be affixed to the uniform of military personnel, firemen, policemen, and members of patriotic organizations.”

Dear Governor Swartzenager of California;

It has become apparent that our California Government has failed in there contract with its citizens in dealing with the funding of our children’s education. The tax payers of California and our past Government representatives came upon and structured a California lottery to benefit the education of our children while providing a lottery to participate in. The deal was voted on and the contract was made. The funds created by our new lottery were to be used as additional funding and never instead of or replacing the responsibilities of our Government for the schools of California. In your current and past budgets you and others before have reduced the funding to our schools and thus have broken the law we had created. You see I feel since you have broken the contract we have created by the vote of the people you have thus abandoned your right to receive any Lottery proceeds. Was the creation of the California Lottery not a contract between government and its citizens? Did we not draft terms in which to hold the contract valid? I feel there is no disputing these facts and that the California Government must now return all funds we provided with interest back to the Lottery Pool. From there the lottery must refigure all jack pot winnings and disperse funds accordingly.

Or the Government can balance past deficits and currently fund the schools and bring our contract valid. As for moving forward maybe we need a new contract and change the requirements of all involved.

From the Enron Scandal to the Santa Barbara Pension fund fraud, there is a history we are allowing to be repeated!

I am so focused on local corruption I almost missed it. How could Enron be allowed to play out there crimes against the American Public when clearly by being on the Justice Departments watch list there were grave concerns by our Government? In other words the Enron scandal did not break until almost 2002. All I can do is ask does any one have more to share because if I can find this data what else is missing? The placing of Enron on the watch list came at the height of there share price, right about 90.00 per. I wish just one time could our Government would be irresponsible in the favor of it’s citizens. Just once could we waste a billion dollars and be wrong with the intent of protecting us? Just once could we actually implement a investigation before the American public was cashed out by the current financial scandal? Could we just once err on the side of attempting to serve those they are sworn to? The money is wasted either way, just once make it be because my well being is actually the focus as it should be.

Now moving on lets review the Santa Barbara County pension fund for a moment and its possible relationship with Enron. This next portion is of an audit report dealing with Enron might be of interest to our current Pension Fund Issues

The other issue here is that because of the conflict Mercer had with what was presented them by Santa Barbara County they did not attempt to validate the actual accounting that was presented for this audit. What no talk of Morgan Hill and what happen to it's students Cinco De Mayo? All American Rights matter to us!

Ran across this in class and want to forward it since it took place in Morgan Hill and maybe your kids went to school there. I found it interesting considering how passionate you are about kids and about your heritage. Clip is school kids sent home for wearing American flags on Cinco De Mayo.....take your clothes off or go home.

What this email is about is there were 5 kids who had an American Flag on there cloths. This happen on May 5th or Cinco De Mayo a celebration of the undermanned Mexican people standing up and defeating the French at the battle for Pueblo Mexico. Now is it just me or should all free nations take part in the celebration of liberty, regardless of origin? Now these students with what little facts I know were incorrectly and against the law told they had to change there close or go home by what I feel is the irresponsible act of an adult.


Wow were do we begin. Americans in school celebrating there heritage and other Americans told they could not at the same place and time, The stupidity that we are different just gets magnified every time one dumb act is allowed to represent the non issue as a whole. Are we really going to lay claim to days on a calendar and be told when and where we cannot celebrate our heritage. First off I think it was very cool that 5 kids decided as a group to do what ever they felt and I am here to fight for there right to do so with the same passion I fight Wall Street, Mortgage fraud and the illegal and unconstitutional use of the term Gang. So lets work of the K.I.S.S. principal for now ( keep it simple stupid). So next March 17th in Morgan Hill if I wear a flag instead of a shamrock will I be sent home from school and than who do we get mad at? This pretty much ends this non issue don’t you think?

An for those of you wondering how the public in general feels about Cinco De Mayo and St. Patrick’s Day? There are two of the most abused days on the calendar year by marketing executives across the nation in regards to the sale and consumption of alcohol. Lets be honest here how many of you have not hoisted a green beer or a shot of tequila on either of these two days.

Best as I can tell American rights to freedom were violated and I just wish it at happen on Halloween instead.

There are many ways to abuse a person, like when you drug them beat them and than take them by ambulance to a hospital.When they are returned to the care facility everyone acts as if it never happen, until you find you were billed 8000.00 We are only on the tip of iceberg and games played in this county.

Now you might remember when I shared the oddities in the transactions involving a property I formally owned. I left that posting with a question. Why would you buy a house in 11/08 and sell it for 100,000 less in 01/09? What I now find odd is that seams to be a current trend in Santa Barbara look below and see for yourself. Now if I recall correctly a former Attorney / Real Estate Broker / Candidate for City Council just might have a role in one of the properties below. You might recall that I had some very serious concerns on how he wound up before Judge Hill for a misdemeanor that never should have left the Figueroa division. Why waste a Trial Court Judges time when far more serious matters are still back logging our court calendaring system.

I hope you see all it takes is a little effort and things can be uncovered. I find it funny people question why I attempt to expose Corruption. You see that is supposed the natural reaction in this Country that is not available in many places around the world. I am not as odd or out of place as some would have you believe
