Ethics in the Santa Barbara District Attorneys Office. Double talk from now Santa Barbara Criminal Attorney Josh Lynn, why am I not surprised?

How is it the Santa Barbara media has failed to recognize that two of Josh Lynn's main contributors when he ran for Santa Barbara District Attorney were just arrested. Both Eric Bjorkland and Kelsey O'Reilly were arrested and called Major Drug Traffickers by our Santa Barbara County Sheriffs. So than what are the implications one might take away from this? Did we teach our Youth and Gang members to always contribute to Josh Lynn campaigns for District Attorney in return for future favors? Now according to what I have read in the media the investigation took over one year to complete. Does that mean drug dealers were seeking protection by Josh Lynn from on going Sheriffs investigations while he was in the D.A.'s office? Is there any correspondence between the criminals and Josh Lynn while he was in office? Don't you think we should find out? Better yet why am I they only one willing to even talk about the matter? Oh wait this is the good part. From what I heard today Josh Lynn is now there defense Attorney and is claiming "a double standard"? Are you telling me if Josh Lynn had been voted District Attorney he would have chosen not to prosecute his drug dealer friends based on his comments today, I am confused? So than his brothers in law Enforcement would not have been able to count on him in a professional manner even after voting him into the office of Santa Barbara District Attorney? Before I get a head of myself is Josh Lynn really saying that our Santa Barbara District Attorneys office does in deed have a double standard? Will he testify to that? So than I have one more question and a closing thought. If an Investigation and criminal charges could be filed against say elected officials like our Santa Barbara Board of supervisors, would Josh Lynn have acted? I mean the Santa Barbara Board of Supervisors did allow the abuse that lead to J. Lynn being temporarily assigned acting District Attorney. Did that happen because of the SBCERS Pension fund fraud I am uncovering and the board was seeking protection?

Well Mrs. Dudley you do not seem to be indebted with any such nonsense, maybe you will create an investigations into both Josh Lynns past association with drug dealers and the current Pension fraud issues I email this to you as well. An about the anonymous tip I received on the Craigslist last year naming the two charged as drug dealers, It sure did not seem to bother any one since I emailed it direct to Mr . Lynn. Just my thought but I sure have some more ethical concerns in regards to our District Attorneys office and lack of response to anything other than the Quaids! Oh yeah a Court appointment October 18th even though the D.A. has yet to press charges. Ethics missing every where!

Concern over Santa Barbara District Attorney candidate Josh Lynn's firing, who cares?
My Response to “Law and disorder in D.A.’s Office ( A story in Thursdays news press).
Ever since last Monday I am stunned by the double standard a select few wish to exercise in regards to recently fired Deputy District Attorney Josh Lynn. To show concern for only is civil rights with all the outrage in this community over corruption and abuse in our local courts. My feeling is that Josh Lynn should be ashamed of himself complaining his rights were violated. Try being a 12 or 14 year old boy and only getting referred to as either an alleged or a Gang member every time Mr. Lynn spoke. What about there civil rights? In the needless death of Angel Linares reports of over 100 kids were at the scene, yet over half were not involved in the fighting. They showed the intelligence an respect to the law and got the hell out of there. Yet we never reach out to that portion of our youth, why is that? Just yesterday 06/24/10 in the Santa Barbara News press under the classification of Guest Opinion Terry Tyler a retired Certified Public Accountant made several bold statements in support of the “alleged” victim Josh Lynn. I agree with his opening statement;” Something has gone terribly wrong at the Santa Barbara District Attorney’s office and no amount of spin can hide it.” Mr. Tyler may I make one small suggestion; something HAS been terribly wrong in the Santa Barbara District Attorneys office. I stand corrected though because after a second viewing of your opinions I agree with more than I thought.
1- Mr. Lynn ran an attack campaign making accusations of corruption.. Thus possibly upsetting and possibly exposing many of his colleagues in the D.A.’s office to the same unwanted scrutiny.
2- As information comes out Mr. Lynn went to the press and a story was run without verifying the facts first as to why the 1 day leave. The story appeared in the Sunday press almost as if a favor to Mr. Lynn since everything he was claiming was to have happen Friday after hours. Any responsible journalist would have held the story giving some professional courtesy by contacting Ms. Bramsen when she became available. Than and only after factoring in her comments an reasoning would a story be released instead of shooting from the hip for cheap theatrics.
3- Mr. Tyler feels this was a punishment handed down to Mr. Lynn after the election. I feel that maybe some people not in the know should let a sleeping dog lie. I have come across several people who claim Josh Lynn was there marijuana dealer in years gone by. In a reply I received to one of my postings the person raised several questions regarding contributors to the Josh Lynn campaign. The contributors claimed to be D.B.A. xxxx and donated 5000.00. However upon reviewing the D.B.A. the names of the donors and the business did not match. I must admit I have not verified that fact but there is more. The person than went on to say that in fact the donors had just purchased 100 acres in Santa Maria for illegal marijuana crops. I am not sure how to digest this except to say did that act represent some type of election fraud? If indeed the donors are not as they claimed and should the District Attorneys office investigate that?
4- Are you kidding me Mr. Tyler, “what a horrible message this action sends to others, who will now dare to run for office”. Can you Say TOM SNEDDON one of the most vindictive S.O.B.’s every to falsely claim he was a public servant.
5- Mr. Tyler also adds” What about freedom of speech, what about Josh Lynn’s civil rights.”? Mr. Lynn has the right to free speech he just does not have the right to lie about what was actually happen in order to seek public sympathy. As for his civil rights, I will get back to that subject in just a moment.
6- Mr. Tyler than goes onto say ‘With all the problems the District Attorneys Office has had throughout these last few years, this is exactly what the office doesn’t need.”. I again find myself agreeing with Mr. Tyler. What if the firing of Mr. Lynn is in fact addressing your brilliant observation?
7- Thank god a C.P.A. brings up our County Budget problems. Mr. Tyler did you know that over 1 billion dollars goes of the radar for a whole year? That’s right Mr. Geis our County Auditor-Controller goes so far as to draft a letter clearing up concerns some appeared to be having mid 2000’s. With our county pension fund. The odd thing is in the attempt to clear things up Mr. Geis shows accounting in that letter for 2000,2002,2003,2004,but not 2001. So I than check all the yearly reports and almost 99.9% of 2001 data on any yearly report is absent including 2001 altogether. I than look into who was the auditing company used by the County. Santa Barbara was using KPMG, so take a peek at there lack of credibility below. An one more note I think they are still in service to our county Pension fund.

My point is this Mr. Tyler, while Josh Lynn was in control of the office, did he investigate any of my findings I forwarded him?
8- Mr. Tyler you question the level of service we can expect from our elected law enforcement officials and the actions of Ms. Bramsen and newly elected District Attorney Joyce Dudley.

I question the motive behind concerns being put out Josh Lynn’s way. I feel the good old boys are upset there hand picked successor failed to meet the objective assigned to him. When Joyce Dudley was publicly pulled off her case load in inner office politics and was replaced by corrupt Mary Barron were you worried about her Civil Rights, or disrespect she was forced to face in public? When Judge Ochoa sentenced Peter Jeschke for 2 counts of having sex with a minor in the lightest possible fashion did her acting supervisor Josh Lynn publicly support her? An by the way why was there no suspended sentence for Mr. Jeschke since he had a second trial coming up. To be honest we have not heard anything about that outcome either. Hell Josh Lynn could not even concede the election in a professional manner allowing Joyce Dudley a victory speech.

More than that Mr. Tyler what about my civil rights with 7 false strike-able felonies? How about the civil rights of those falsely accused with a felony from the old Santa Barbara district attorney’s office. The only thing you can call it is malicious prosecution when 30% of those originally charged with a felony are dismissed? However not until they are forced to pay the higher felony bail and attorney fees. I feel if Josh Lynn has had his rights violated he is entitled to his day in court. If that day in court is in Santa Barbara he will need more than good luck just ask the 14 year old boy framed for murder, Ricardo Juarez.

If we do not care about those we are sworn to protect what right do we have to complain when our own rights receive the same unjust treatment?

I'm Glad buying the Santa Barbara District Attorneys office buy drug dealers is a joke!

Two main contributors,Eric Bjorkland and Kelsey O'Reilly to than hopeful candidate Josh Lynn for Santa Barbara Barbara District Attorney have been arrested. The two along with several others have been accused of being as Major Drug Traffickers!

Funny how I received an anonymous tip 6 months ago on the Santa Barbara Craigslist that the Josh Lynn for District Attorney contributors were A. Drug Dealers an B. had just purchased another 100 acres to grow there pot. Yet here it is a week since the arrest and the only person asking about ties to Josh Lynn and Drug Dealers buying the D.A. office is me. I mean when you think of all the people like form D.A. Tom Sneddon and C. Stanley endorsed this fool it has to make you wonder. Next on my work load will be Muni bonds and the contradictions they represent in regards to to County Financial s and the SBCERS pension fund. I guess when Josh Lynn said "they must fear him" he meant kids from the East Side and not his Millionaire friends that supply the illegal drugs to our society?

After a year long investigation, a large scale marijuana trafficking organization has been dismantled by the Santa Barbara County Sheriff's Department Narcotics Unit.
During the investigation, it was found that the primary suspect, Erik Bjorklund, was growing marijuana at his residence in the 2900 block of San Marcos Pass Road. Additionally, Bjorklund also had a property in the Tepusquet Road area of Santa Maria where he was growing marijuana with another suspect, Kelsey O'Reilly. The investigation found that Bjorklund was exploiting Proposition 215 / Senate Bill 420 and selling mass amounts of marijuana throughout Southern California for profit.
An additional business partner of Bjorklund's, Jeffrey Vines of Ojai, was found to be bottling large quantities of a liquid mixture with alcohol and cannabis for Bjorklund. He was also found to be a high-risk sex offender on active CDCR Parole with GPS monitoring. A large amount of suspected child pornography was located at Jeffrey Vines' residence in Ojai.
Search warrants were served at (7) separate locations in Santa Barbara and Ventura counties. The following was located and seized at the Santa Barbara and Santa Maria locations:
• Over 900 active marijuana plants. (Indoor and outdoor) Outdoor could yield over 4 lbs per plant. Rarely seen in SBSO history.
• Over 300 pounds of processed/bagged marijuana for sales.
• Over 50 pounds of hash.
• (28) 5 pound containers of hash oil, full hash/hash oil conversion lab (worth several million dollars street value).
• Over $125,000.00 cash, (1) 2010 Porsche Panorama, (9) motorcycles seized pursuant to State Asset Forfeiture laws.
It should also be noted that several pounds of processed marijuana were located in a child's room at Bjorklund's residence.
The suspects arrested and booked with the charges requested are as follows:

Erik Bjorklund DOB: 09/02/55 (of Santa Barbara)
Arrested at the San Marcos property and Booked on a $2,000,000.00 Ramey warrant for 35 counts of Money Laundering; 11370.9 H&S / 186.10 PC, Additional Charges: 11360 H&S Sales / Transportation of Marijuana, 11358 H&S Cultivation of Marijuana. 11359 H&S Possession of marijuana for Sales, 273a (a) PC Child Endangerment, and 11379.6 H&S - Hash conversion lab.

My girlfriend at the time and I rented a room on this property way back in 96-97. Nice people, Eric and the others living on the 'compound'. But insane stoners. Never been much for dope myself so I never got into their clique, but there was always good food being offered from one of the modulars or another. The communal hot tub had a great view too.

Bummer for them, this fixation with pot that our fair leaders are imbued with is so unbelievably silly. I fear we just have absolutely no representation by our true peers anymore.

The Dutch learned easy pot has been disastrous for their country and are now cracking down. Check out the news from the Netherlands and see what is in store for California if Prop 19 passes. Dead end state, huge social costs, lowered productivity and lost generations. That is what the Dutch learned and they tried to make it work. It didn't.

Damn that was a lot of Hash......If I am not mistaken it too is smoked and is a oil.Marijuana in its true form is actually not all that bad comparingly.......but smoking THC as a oil base must be terrible on the users system.That must have been a couple lifetimes supply.....or proof that they were not using it as personal consumption.Well this goes to show that given a inch,some will take a mile or two and its just not Marijuana growers....its all facets of business.Sad to see that busts like this give a black eye to the honest medical use growers.I still believe Marijuana can help those truly in pain from a huge variety of disease's and without it,those who cannot afford the pharmicutical bill associated with pain......will suffer.

513, that's not what I heard today on CNN today. They interviewed a former police chief of Amsterdam and he said 5% of the population identified themselves as pot smokers. While here in the U.S. the number is 6%. Percentage wise, fewer people smoke in Holland than in this country. And this is a quote from Wiki,

Maijuana-shmarijuana...the locals have been smoking pot responsibly forever, and it's not going anywhere so get used to it and pass prop 19...even the local Chumash Indians used to cultivate and smoke marijuana, and used it as a daily ritual of thanksgiving at the end of the day...also used it in each household to meet visitors at the door and have a ritual toke before they entered to harmonize the vibes. To the uninformed: Cannabis is a medicinal plant. Our bodies have an endogenous cannibinoid receptor system that responds favorably in most people to the substances of this plant. It is not considered addictive in most users. It has far less culpability in crimes, motor vehicle accidents or violent assaults.

There are no "alcohol" receptors in the brain. Alcohol is a toxin to our systems. Cannabis is not. Get your facts straight.

Wow- what a huge amount of potential tax revenues gone up in smoke. We could get the whole state out of debt if we just legalize something you cant stop anyway. Pity. People will grow their own, and bootleggers will sell it tax-free. And when the state does tax it through the roof, stoners will scream bloody murder that they are being taxed too high, pun intended.

Your rationale is to legalize it because it can't be stopped? You can't stop the abuse of every other drug out there, so why don't we legalize all of them? Can't stop domestic violence...heck, let's legalize that. Drunk driving? Sure...raise the BAC ceiling to 0.24.

Santa Barbara- After a year long investigation, the Santa Barbara County Sheriff’s Department Narcotics Unit has dismantled what they are calling "a large scale marijuana trafficking organization."

Authorities served search warrants at seven separate locations in Santa Barbara and Ventura counties. The following was located and seized at the Santa Barbara and Santa Maria locations:

*over 900 active marijuana plants. (Indoor and outdoor) Outdoor could yield over 4 lbs per plant. Rarely seen in SBSO history.
*over 300 pounds of processed/bagged marijuana for sales.
•over 50 pounds of hash.
•28 five pound containers of hash oil, full hash/hash oil conversion lab (worth several million dollars street value).
•over $125,000.00 cash, a 2010 Porsche Panorama, nine motorcycles seized pursuant to State Asset Forfeiture laws.

Authorities also made several arrests. They say the prime suspect, Erik Bjorklund, was growing marijuana at his residence in the 2900 block of San Marcos Pass Road. Additionally, Bjorklund also had a property in the Tepusquet Road area of Santa Maria where he was growing marijuana with another suspect, Kelsey O’Reilly.

The investigation found that Bjorklund was exploiting Proposition 215 / Senate Bill 420 and selling mass amounts of marijuana throughout Southern California for profit.

Also according to a Sheriff's press release, an additional business partner of Bjorklund’s, Jeffrey Vines of Ojai, was allegedly found to be bottling large quantities of a liquid mixture with alcohol and cannabis for Bjorklund. He was also found to be a high-risk sex offender on active CDCR Parole with GPS monitoring. A large amount of suspected child pornography was located at Jeffrey Vines’ residence in Ojai.

Here is a list of the suspects and the charges, according to the Sheriff's Department.

35 counts of Money Laundering; and additional charges including sales/transportation of marijuana. Cultivation of Marijuana, as well as Child Endangerment.

More Accusations shared about Josh Lynn and his Contributors on the Web. Are Drug Dealers Involved with D.A. Candidate Lynn?
This was posted on craigslist Today. People are beginning to be some what vocal and willing to say there are issues in the District Attorneys Office. It might not seam like much but your comments and concerns should be shared on places like Craiglist or as an anonymous comment on my blog. We should be supportive of one another and let others see there are a lot of us. All I am asking is to do exactly what they do. The pick a place to share racist untruthful comments because it does matter. So just think about that please. To everyone I work with how many people did you get to share our concerns with last week? The Group P.A.D.R.E.S. had a press conference and that hit the media Bravo. I have had 4 x the hits on my blog in the past 9 days. I have had a high of 117 that I shared before and yesterday was 100. and in between 50 or sixty a day. I know it's not much but its a start. My postings are rarely about me but about concerns we all seam to share. Start your own blog and link them together. Once you decide to go for it post the secrets you keep that everyone knows to be true. I invite the Frimpongs,Hollywoods, and Monihans, the Armijo's, and countless others who has been a victim to vendetta justice to do so. Please at the very least share your fights anonymously. I know people are working through the courts and the above people are all wiser than I. I have been privileged to private thoughts and documents and I would never violate that trust by sharing anything I was not given your permission to do so.

My stance has never changed we all must be responsible for our actions to society. Larry Mendoza ( American)has problems with how Ricardo Juarez (American)was treated by Judge Hill(American) I also have issues with how David Abraham ( American) was not held accountable to our (American)law. Not my Law, not Josh Lynn's Law. No the Law I speak of has so many defenders, Americans, Mexican/Am Jew/Am Italian/Am German/Am Black/Am and of course Native American have all lost there lives while serving there Country and our way of life.

I have tried not to give Race much attention because I will not allow them to suck me into that type of thought. We are a Bi-Cultural Country by design which was the reason our Fore Fathers set out to always defend and respect freedom in all shapes and form.

Kelsey O'Reilly is not listed as an owner on the DBA of Erics Tree Service. Does he work there or own it? A couple of years ago O'Reilly and Bjorkland bought 100 acres of land in Santa Maria where they have a large marijuana grow operation. Did there donation money come from this source and are they paying taxes on this money? Are they buying there way into the DAs office? And why? How do two marijuana growers/dealers benefit from helping a DA?

These are questions that need to be answered.

How might one take advantage of the data in these reports?

1- Compare the yearly growth of another County or City to your Pension plan and see if the percentages match, For example When Santa Barbara County's Pension Fund obligation grows one year at 9% from the following year at 25% why such a discrepancy growth spurt between the 2 years?
2- Compare Pension Fund values to others with similar sets of values. For example Santa Barbara with it's 4500 members could be compared to Sonoma, Stanislaus, San Joaquin County Pension funds. Compare amounts of yearly County employer employee contributions, or the Growth of the Pension fund obligation since the Counties I mention above are all within a few hundred members of each other.

I keep asking the question just how stuck on stupid are we Americans.? As I have done many times before I get tunnel vision and miss some very important data while I rant away about fraud or corruption. This morning I reviewed the investment returns and fund performance of Ventura County and there retirement system. I hope we can all admit the math just does not add up. Please stop and really look at the chart I have enclosed for a second time today. There are 16 Counties listed and the average 5 year return on investments PER COUNTY IS 14.84%! Every County was able to more than double there pension fund value from the previous 50 years in that 5 year span, EVERY COUNTY! As I have mentioned before I went to Wall Street and pulled Santa Barbara County bond offerings and came up with some more conflicting information. In 1989 as reported by me we can find a SBCERS Pension fund value of 225 Million dollars at a 77% funded ratio which is equal to a 290 Million dollar future obligation. Than in a 1992 Bond document I find a Pension fund value to be 445 Million dollars with a 495 Million dollar future obligation. Well that shows some progress in closing the unfunded liability down, except there are a few problems with the math. If we take away the Investment bench mark of 8.16% investment return needed for SBCERS to stay a head of future obligations how would the Pension fund grow? Only if Contributions were larger than debits. So than 290 Million with 3 years of return on investments at 8.16% the funds target rate would give us a future obligation of 404 million dollars not 495 million dollars. Take a moment and digest that a 20% misrepresentation by our Santa Barbara elected officials.. Now than if the pension fund value was 445 million as reported in that 1992 bond document what was the rate of return on investments for that 3 year span to see a 220 million dollar growth or in other words. In just three years time the SBCERS pension fund out performed its previous 50 years performance and HARD MONEY CONTRIBUTIONS since the value in 1989 was only 225 million dollars. An that is the same performance you get with all of California County Pension funds during the 5 year span listed on the chart below. What of the Trillions of dollars missing in Pension fund value and how much tax revenue is lost. I mean the pension pays out and Uncle Sam collects taxes. I wonder for every day California goes with out a budget how much Governor Schwarzenegger and want to be Governor Whitman earn in there limited partnerships with Goldman Sachs and there Global Funds. We need to quit letting Sacramento and Washington think they have us fooled. The math will just not let them get away way with there crimes and where they really get caught with there cheating. There fraudulent accounting was made up by there under representing of pension fund value. You see once we do the math and provide correct fund values the maximum they can claim as losses is there previously stated dollar amounts they have already claimed and not the percentages they tied into that fraudulent effort. For example SBCERS at one point claimed a 24 percent loss in fund value or 422 million dollars. Well my fund value is closer to 3 billion dollars and that would equate to a 750 million dollar loss not 422 million at 24%. So the powers that be have painted themselves in a corner if we can investigate and get the tax payers money back, SOMEBODY HAS IT!

So how hard is it really to question the math and Pension Fund values as they have been reported to the public of California? Below is some data that the Santa Barbara Grand Jury put together back in 2000 in regards to the California County Pension funds and values. I will now use this data and the 2007 CAFR audit to challenge the past reported value of the VCERA or Ventura County Pension Fund. As you can see once you review the Ventura Pension Fund value in the chart below we start with 2.1 Billion dollars and a 5 year average investment return of 14.8%ending in the year 2000, wow talk about outstanding results. That works out to about 1 Billion dollars growth in 5 years! Oh hold that thought because if you look just below this chart you will see I have pulled some more recent data off the 2007 CAFR audit. Now in this audit there is a claim of 11.2% investment return for the previous 5 years starting in 2001 and coming forward to 2007. In the same passage though there is also a claim of only a 8.5% for the previous ten years, that's odd 14.2% return claimed in one five year span and 11.2% return claimed in another five year span. Regardless with a 122% funded ratio in 2000 and the next five years seeing results of 11.2% how is it possible this pension plan went sour and had to change to a two tier plan. You must remember that a 12%average investment return per year will double your investments every 7 years! Yes double your return every seven years. So based on that information and a 2.1 billion dollar starting point. Than you must also remember to add the contributions by employer employee's during that span and the VCERA pension fund should have a value in excess of 4 billion dollars. Well you must know me and how I love Pension Fund "Magic"math. I did the math and actually came out with a value of 4.7 billion dollars for the start of year 2008. Yes I rounded out to keep it simple but these return rates just make it imposable to have another under funded Pension Value! I also included some other data from the 2007 CAFR audit that shows there claim of underfunded future liability. I posted there employer employee contributions and a link to the 2007 CAFR report. So if you have the same serious concerns I do with the SBCERS or Santa Barbara County Pension plan, you should review Ventura's audit. The County government in Ventura have a totally different array of excuses for there Pension funding issues than our Board of Supervisors here in Santa Barbara. I really hope that my work makes more sense than what our government has been reporting to us in regards to under funded pension plans. If you really start to understand the math and investment return issues you can break down the funding issues rather fast. For example my break down of Ventura and there Pension issues took less than 5 total hours of additional research. I hope my concerns are well thought out and easy to understand. If I have succeeded than I have one more thing to ask. Please start sharing these emails that deal with pension funds with everyone one you can. Take the time to digest there content and let's really start to shake things up. I recently heard Father Boyle speak of Homeboy Industries and he is simply amazing. I am going to borrow from the Father ( one cannot steal from a priest www.homeboy-industries.org/march20.php). "You will be told you are wasting your time and nobody cares". 'However is it not in ever Americans job description to participate and protect each other and our Country". Father Boyle please forgive me but I sort of borrowed your insight for my work. If Father Boyle were to reply he might say "Knuckle head" you are doing good work and I am ok with your usage. I ask once again please take the time to understand my position on the math and if it makes sense start asking questions. Pascual Gamboa we will miss you my friend!

There have been quite a few write ups these past 10 days all speaking in high regard about Pascual Gamboa and how we all felt about him. I was probably just ten or eleven when I first met Pasqual. Going every Saturday to his restaurant on Carrillo for my mom's standard order of his Chili Verde burritos.. I have lived here in Santa Barbara most of my life but I did leave for about ten years. An there is one visit in particular that every one seams to be remembering. You see Pascuals was were you went when you came back home. If it was Fiesta's and Bob Burton was in Florida you might here Bob was here last night. Maybe Jerry Palacios was in from the Navy and his brother Mike was with him. You might run into Pancho and Virginia and every one knew when her cousin Michael arrived with his million dollar smile and new Fiesta shirts. My friend Hank would be at the door and wonder woman would be working. Randy Equihua might be there talking about how I could never make the Kool aide when I lived with them. I might drag my brother and Tim Lopez in or say high to Barbara. So what drew us all to this establishment. It was the man Pasqual himself and how every one was treated. I might not walk in that door for six months or a year but when I did arrive it was always just special.


Oh about that one visit everyone seems to be talking about happen with me and Julie sitting in booth six. If you read the Independent story from yesterdays edition it almost get's the story right. The most amazing part about when Pascual went into the restaurant on the horse for fiesta was missed by almost everyone. You see as the story in the independent says Pascual was sitting tall in the saddle and all of a sudden the horse started bucking as they were turning him around. Steve Cordero's dad was a booth or two away, I had to dive to my right. Richard Avila's cousin was holding Julies arm so tight that when Julie stood up on the seat in the booth she pulled her right up with her. Tables were busted and it seamed to take a bit for the horse to be calmed. That's when I noticed that the person guiding Pascual and the horse had the reins in his hands. Pascual was puro Charro staying on that horse showing no fear until it was over with no reins! 68 year old Charro, it was awesome. Any how of course Pascual felt bad and kept coming over to us in our booth. If I recall it was 3 beers, 3 shots and he sang 3 songs to the ladies. On my way back to Galt that Sunday we stopped in Kettlemen city. In the gift shop at Harris Ranch was the leather horse, it sits in my living room to this day a reminder of that Fiesta. I love you Pasqual, you will never be forgotten rest in piece, I will always remember the fun (the ones 1 can remember)I had with you and your Crew. Thanks Lucky!


To Pascuals Family my thoughts and prayers, I am sure you have been hearing memory after memory from all his friends.

There is nothing funny about the Quaids sitiuation in Santa Barbara

So just last Friday I was out having dinner with a friend from out of town. I mentioned to him that my work is much harder now since it requires greater research than when I first started. My earlier postings were more of an observation type and actually quite easy to compose. Once I understood the law or procedures as they applied to a given situation I could apply that knowledge to other cases with similar components. An guess what that is exactly what I am about to do in regards to the recent actor Randy Quaid's arrest. Now I did go on line to review public comments on a local news agency’s internet web page to take a pulse on how people felt. To be honest everyone just seemed to be making fun of the Quiads and no one had the same concerns as me. This of course is not the first time my views are different than the general public but here goes anyway,

“Randy Quaid was handcuffed without incident, but deputies where forced to restrain Evi Quaid who physically resisted arrest. Randall Rudy Quaid (DOB 10/1/50) and Evegenia Helena Quaid (8/2/63) were booked into the Santa Barbara County Jail after 9pm Saturday (9/18/10) for felony residential burglary (459PC) and misdemeanor entering a non-commercial building without consent (602.5 PC). Evi Quaid was also booked for misdemeanor resisting arrest (148PC). Bail is set at $50,000 each.”

The above story estimated damage to be 5,000 dollars while the Santa Barbara News press claimed the damage to be 10,000 dollars. So lets move forward to what is now being claimed in the Santa Barbara News press, It seems the Quaid's are possibly scheduled for Santa Barbara Superior Court October 18th after both bailed out early Sunday morning. Except there are a few problems with that story. It seems that the Santa Barbara District Attorneys office as of Monday afternoon did not have an investigation report from the arresting law enforcement agency and there for had not decided that charges could even be filed. The story also went on to claim how the arrest now appeared to be misdemeanors and not felonies. How can the Quaid's even have a future October 18th court appointment when no charges have been filed? We know there has been no arraignment of the Quaid's since charges have not been filed. It makes no sense if you are aware of court procedures following an arrest. No arraignment but you have a future maybe court appearance. Oh thats right if you review a portion of my blog below regarding the Quaid's appearance last December there felony appearance's than were going to be “VOLUNTARY”.

Now please keep in mind this is the Quaid's fourth non appearance and a felony warrant had finally been issued. “Right now technically they’re Fugitives AGAIN” said Senior Deputy District Attorney Lee Carter. Now even if I tried I could not make Judge Anderson sound any dumber than he did in the quotes in the paper today.” Although the original three or four appearances were going to be voluntary we ended up with no appearances” Said Judge Anderson.

People there is no such thing as a Voluntary Felony appearance, all persons charged with a felony must be present in person at every required court appearance that is the law!

Since I am reviewing the Court lets see what else has been piling up on my desk waiting to be reviewed. That recent 'Gang case with 4 defendants that ended up with a hung jury had a secret. For some reason I have yet to figure out there was actually two trials going on at the same time against Mr. Mize and only 1 case against the other 3 defendants. What I don't understand is why the media, the Judge, and more importantly the Santa Barbara District attorneys office did not make this public knowledge from the outset. Maybe I missed the story but I could have sworn I wrote a recap from the outset of that trial and I missed there being two trials in one. I just find this odd because now it appears the other 3 defendants no longer wish to have there trials mixed with Mr. Mize's and have filed a motion to separate themselves from him. But two trials at once was ok.

Now because of the huge media attention a 14 year old being being charged for murder in Ventura has received they have actually drawn there jury from Santa Barbara to assure that the defendant receives a fair trial. I wonder if the three defendants from above would like a jury from outside of Santa Barbara as well? What about the Henry’s beach preliminary hearing and all that alleged “Gang” activity that started the whole indecent? As it turns out the victim and a friend actually started the confrontation that resulted in the first fight by cornering Mr. Gallegos. The military trained victim was able to take down the alleged “Gang' member and I guess beat him in a fair fight. The defeated “ Gang' member than got up and shook hands with the victim. How in the world was this person first arrested for the murder based on that account? You see Josh Lynn you take your medicine and than act like a man and congratulate or acknowledge the victor with class and dignity. Josh you could learn something from this alleged Gang member. I understand the person was later killed by a cowardly act and my prayers go out to his family and friends but the confrontation was over cigarette butts on the ground! The second person to be arrested for the murder has never been identified and yet held over for trial, thank you Judge Brian Hill. If they made a mistake in the first arrest how can we be sure there is not two mistakes?

Now mind you in order for Judge Hill to be part of this preliminary hearing for a defendant not yet bound over for trial he had to push two murder trails back. The Lyons double murder and the trail for the coward that murdered my friends daughter have both been pushed back. Even though both trials had already been set for July since last April.

What about the recent marijuana dispensary preliminary hearing. Well as it turns out the Santa Barbara district attorney's office won the preliminary hearing but has decided to wait for the people of California to vote on Marijuana in November before deciding what to do. Only problem is that the D.A. must file a felony information (new charges) in Superior Trial court within 15 days after the conclusion of the preliminary hearing as we learned in the Ricardo Juarez case. Wait there is more wrong with the Marijuana case. It seems that assistant Santa Barbara District Attorney Brian Cota admitted in the recent media story I read. That if 3 of the 4 co defendants were to take the stand in a trial they would be found not guilty. So why charge them in the first place? Now this was only a preliminary hearing but why did the main defendant take the stand in a case that may not ever hit a court room after the November election? Any defense attorney worth his salt would never have allowed that.

Yes we could all sit back and make fun of the Quaid's and there new situation. Or we could could begin to realize that every law and procedure matter. The fact that no one has come forward to agree or challenge my findings in regards to the SBCERS pension fund has me flustered. When are we going to get off of being stuck on stupid? There is nothing funny about any of it.

So when does Judge Hill rule on the Lyons whisper tape? After all he allowed the Juarez whisper tape.
When does public defender Karen Adkins missing 60 page motion filed 12/07 alleging misconduct by Judge Hill and the District Attorneys office turn up? I have checked the court house files and the motion has gone missing. When do alleged gang defendants have pre-sentencing probation reports put in there case files as required by law?
By the way in the nun scammer case that is coming up. Was Judge Anderson allowed to give testimony? The alleged couple or victims in the nun scammer could not agree if the were victims or not. The wife came forward and claimed not to be a victim. Judge Anderson than gave testimony by way of public statement and said” The wife would say anything to clear her friend' . Did Judge Anderson have to be sworn in to make that statement?

In all my court case's as well as most personal issues these last 5 years I took every shitty deal or offer put before me. Only to have that rubbed in my face and the terms altered. Nothing about any of this is funny.

Well as you can see there is a ton on my mind but I ma here today to explain why both past and present Santa Barbara elected officials such as the Board of Supervisors and County Controller Robert Gies must be criminally charged for fraud and misuse of public funds. Very quickly here in 1989 the County of Santa Barbara reported that SBCERS pension fund had a future obligation of 290 Million dollars with a value at that time of only 225 Million dollars thus only 77% funded. I was able to retrieve these figures from the Municipals bond market on Wall street. It turns out when there is a bond offer the City or County which makes the offer must give a current view of there Finances and future obligations. Now on this same bond document there was another choice I could have used. In there reporting investment returns they also had 345 Million future obligations and a 305 Million dollar value. I chose to use the lower of the 2 values for my example. Now all I had to do was the following.

1- start at 225 Million and come forward with the investment return factor.

2- Before multiplying by the return of a given year I also add the contributions

3- Example 1989 I had 222 Million plus 14 million in new contributions from employees and employers. So I went 225+14 = 239 million dollars x investment return factor of 10.5 =

4- I did this for every year and came current and my findings are located at both my word-press blog and at @ www.santabarbaracriminalcourtcorruption.blogspot.com

My results are startling and it boggles the mind to think our current Santa Barbara Board of Supervisors would have us believe there is a current unfunded future liability of 1 billion dollars. When in fact when you bring my totals to 2009/2010 multiply by 10.5 return on investments you get a fully funded pension fund of 3 BILLION Dollars, WOW where did the math go wrong. What does it say when you look at the 2009 SBCERS pension fund audit and in that audit it contains this. That over a given period the Santa Barbara County Tax Payer is charged for 350 Million dollars in amortized pension fund payments to the unfunded future liability. How ever if you follow those amortized payments you find that the Board of supervisors really only makes payments of only 200 Million dollars and do you know why? You see they charge the amortized payment at an interest rate of 8’16% yet there is no need for such a calculation and do you know why? Because the fund automatically will pull up or down the amortization payment based on the future funds performance. So there would be no need for an intereat rate to be used ever

Well my computer is broken so I am at the library. I must wrap this up for today but please remember that the SBCERS pension fund has claimed a hard number lose for the last two years and there for is not entitled to use my math to increase there losses after the fact. I will have to write a much better posting describing the amortization payment issue but another 150 million in fraud uncover by “Magic” no by common sense.

Well it seams I have struck a nerve with someone who wishes to correct me and challenge my intelligence here on the Santa Barbara Craigslsit. So lets clear that up first. I am here to state as fact “ I am dumber than a rock”, hands down no questions asked! Now I hope that clears that up for my most recent critic to climb out for under a rock. So lets do a quick review of just a few of my concerns and hope my critic can reply in a honest manor.
1- Are the police currently not under a contract which can last for up to 1 year with the City of Santa Barbara?
2- If I am not mistaken the Santa Barbara police have also hired some type of firm to review the city budget for mistakes, fraud or misrepresentation of Tax Payers funds?
3- Have I not been a team player regardless of the illegal and past criminal acts against me by a select few Santa Barbara police officers and already shown the P.O.A. how to find a discrepancy in how much funds have been allocated? The Bond market financial VS the City Budget!
4- One day I was sent to City Hall and Santa Barbara Police Chief Cam Sanchez had a big smile for me when I got there, is he smiling anymore?
5- Is it not true one of the main reasons for the actions above against City administrator J. Armstrong on the budget is because he is the Supervisor in charge of Cam Sanchez?
6- An is it not fact Mr. Armstrong in his duties as the BOSS of Santa Barbara Police Chief had to use CITY FUNDS to investigate Cam Sanchez for possible Civil Rights violations over 16 months ago by a firm out of Ventura? Funds that are no longer available in a budget that could be used by the Santa Barbara Police department?

Mr. Critic I have a question for you. Why did the Santa Barbara Independent decide to use a picture of Ricardo Juarez for the recent Issue cover while reviewing “ Gator Roll? It is almost comical that they decided to review the media hoax “ Gator Roll” in the first place. Mr. Juarez is the 14 year boy that was framed for murder by a select few in the offices of Santa Barbara's D,A., Police, Public defender, and even a Superior Court Judge by the name of Brian Hill. I have issues with the picture they used for several reasons.
1- He has never been charged with a R.I.C.O. Crime.
2- In the photo he is clearly handcuffed and wearing gloves. These gloves would be used in the trial as having blood evidence on them. So when he was handcuffed was that missed by the officer?
3- In order to make all Mexican youth look a like for the make shift line up that day, Mr. Juarez had to remove the shirt from the picture. Is that not misrepresenting the facts?
4- If the had used the picture that his tennis shoes appear in they are clean and white. I only bring this up because like the gloves they will later some how “Magically” have blood evidence on them as well.

To frame a 14 year old boy to prove your worth in order to obtain your share of budget allocations is a crime all unto itself. That effort was in part needed because of the crimes by our Santa Barbara County Board of Supervisors in there illegal actions behind the SBCERS Pension fund. I have unclosed a 2 Billion dollar problem that I will not let go away. Instead of a 1 Billion dollar unfunded future liability I find the SBCERS Pension has been allocated enough funds in past County Budgets to actually have over a 1 Billion dollar surplus.

So Mr. Critic in closing this last thought was shared to me by a dedicated Law Enforcement Office and he said “ with out the extra benefit of the Pension why would I want to do this Job”? He went on to explain he leaves his home wife and kids every day so that he can be challenged and forced to fight with 20 year old? Who will do the Job when we lie to the very people entrusted with enforcing the Law? Maybe my critic is smarter than I ?

From the Santa Barbara Bank & Trust to SBCERS Pension fund, just some new thoughts!

Just a couple of quick thoughts that I will expand on as later this week. While glancing at a Los Angeles times business story yesterday it reminded me that there was something still bothering about the Santa Barbara Bank & Trust take over here in Santa Barbara. So I went through my old news papers until I found it. When the news broke in April of this year it read that the Ford fund from Texas was to receive 91% interest in SBBT for there investment. There had already been a 180 million dollar investment from our Government in T.A.R.P. funds and for that they would receive 7% interest in SBBT. In other words the Bank and Mr. Ford would not be responsible to the American public a full repayment of 180 Million dollars, oh no. Based on the selling price the American public received just under 39 Million in Value for there 180 Million invested,  Than we as investors a second time (as the general public) must regain interest buy common shares and raise the stock price. Than at the inflated stock price with no further investment from the Ford group they pay off our debt(T.A.R.P.) with money raised from us the public again. It is all part of the Wall Street and no  one seems to get it. How Stuck om Stupid are we? The scam cannot work with out our money AGAIN! I will get back to this and the tie in to Black Rock Inc. later.

Is it me or did the Santa Barbara Board of Supervisors announce they canceled last weeks meeting to the Public than held the meeting any way?
If I recall correctly and I usually do the SBCERS Pension Fund has had past ties to the Ford fund, does that seem odd? I will investigate and tell you more later.

I have a busy few weeks coming up with my Blog and updating my findings. In closing I have yet to receive 1 challenge that my math or there findings are flawed.  The SBCERS Pension fund after taking in last years Investment performance and using my calculations should have a present fund value of close to 3 BILLION Dollars and that creates a boat load of serious problems for current elected officials here in Santa Barbara. You see because of the over 1 BILLION dollar surplus my research shows our current Board of Supervisors no longer need to risk the whole fund to stay on target. In fact a 5% investment return factor could now be used and this would eliminate the need for any risky future Investments, THINK ABOUT THAT!

SBCERS Pension fund math exposing corruption and abuse by Santa Barbara County Elected Officials? Bell Ca. North

Well folks it has been a couple of weeks and there is a ton on my mind. We have Judge Brian Hill putting off trials so he could do the Hendry’s Beach preliminary hearing. Imagine a Judge putting off the Lyons murder trial so he can keep himself in the press, pure moron. We have another case where the defendant hired or changed her attorney and the reward she received from a Santa Barbara Superior Court Judge for practicing her Constitutional rites was an unjust additional two year prison sentence. We have a very bias review of Gator Roll in the Santa Barbara Independent by writer Chris Meagher. He wrote a piece with out reviewing the case files. You see if he had he would have noticed case’s that included Ruben Mize and co-defendants with out any documentation in the Superior Court Files. In some case’s people were went to prison without there Superior Court file containing a police report, a probable cause sheet filled out, a felony commitment criminal minute or and this is most important. A pre-sentencing probation report, but that is not why I am here today. By the way 2500 presentencing reports a year at the cost to the defendant upwards of 1000.00 that is quite a bit of income for probation. Yet only 600 adults on probation, B.S. the numbers do not add up. It has been my observation 5 to 1 receives probation over prison here in our local courts,somebody needs to review the math. Oh I almost forgot in the Gator Roll review the writer states that in the year 2009 ‘Gang” charges are down., I wonder why Josh Lynn missed all that during his losing campaign for Santa Barbara District Attorney? Surely he was not trying to miss lead the public in his bias actions against our Latino, Hispanic or Mexican youth. Any way you break it down you always leave out the term American Youth.

So after reading that the SBCERS Pension fund has had over 850 Million dollars added to it since 1989 it raises other concerns. If 850 Million is equal to 20 years of Employee and Employer contributions and the fund had a value of 225 million in 1989. That is equal to almost 1.1 Billion dollars in 20 years with out any further investment returns added from 1989 to present. So we alleviate 20 years worth of investment returns with an average return of 7.6% and we have another huge problem. When any normal investor receives a audit or statement of his or her 401k for example it is true you will get a +or – in regards to fund performance and value but there is one key statistic missing on most pension fund audits that I have personally reviewed. THE HARD DOLLAR COST PAID INTO THE FUND REGARDLESS OF TYPE OR INVESTMENT PERFORMANCE. So if we have had an SBCERS pension fund since 1937 what is the total hard dollar cost or contributions into the SBCERS pension fund for the 52 years prior to my research starting in 1989. I mean in 50+ years this county has had to have at least put another 150 or 200 million dollars in contributions, don’t you think? If you recall on my blog page I have a chart that reflects the amount of times “Excess returns” have been pulled from the pension fund and this chart clearly shows a positive return on investments except for a handful of times all the way back to 1937 and before. You see since 1989 we are contributing at a rate that could almost fund 3 separate pension funds. Also in the Los Angeles times I read a story where only police or sheriffs and firefighters receive the highest rated pension plan. An in Los Angeles county nobody else not even criminal prosecutors from the District Attorneys office are allowed into that safety pension plan. So my question; is our local District Attorney, Probation or even the Public Defenders office misusing there pension fund opportunities and how can we be sure?



As for those under funded pension fund amortization payments I mentioned yesterday I have a question. After you remove 15 sheriff positions or 7 police positions and than claim a savings of 150 million dollars in payments not needed down the road, how are those funds redistributed and when was the public going to be made aware of those possible future savings? You see even if all I found was 150 Million dollars in miss appropriated funds my work would warrant an investigation and possible criminal charges.



Take the pension fund value at any point in a time line for example 1969 or 1989 as I did. Add all the following years’ contributions and investment returns to bring a true fund value. Now if and when that math is completed and you did the same for the fund obligation based on the same time line and required investment return needed to keep said fund solvent 8.16% for SBCERS, than and only than can you see the solvency and years that may have required special attention. Furthermore I have yet to find a single person who can tell a true fund value if no log of “Excess Returns” and the location of missing funds. I am just amazed that tax payers are penalized because they benefits they offer over performed.



Just think Sunday what would happen when the Red Skins beat the Cowboys by 2 touchdowns over the spread. The Redskins refuse to allow 2 touchdowns to there totals because they exceeded there needs and your bookie failed to pay your bet off. I know makes no sense to me and neither do the random pulling of funds from an obligation the County taxpayers are held liable for and not our elected officials. Criminal charges must be looked into here in Bell North or Santa Barbara County California.
